General terms and conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period during which the consumer may exercise the right of withdrawal;

  • Consumer: the natural person not acting in the exercise of a profession or business and entering into a distance contract with the trader;

  • Day: calendar day;

  • Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;

  • Durable medium: any device that enables the consumer or trader to store information addressed to them personally, in a way that allows future consultation and unaltered reproduction of the stored information;

  • Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period;

  • Trader: the natural or legal person offering products and/or services remotely to consumers;

  • Distance contract: a contract concluded in the context of a system organized by the trader for remote selling, using one or more means of remote communication exclusively up to and including the conclusion of the contract;

  • Means of remote communication: a method that can be used to conclude an agreement without the consumer and trader being in the same place at the same time;

  • General Terms and Conditions: these General Terms and Conditions of the trader.

Article 3 – Applicability


These general terms and conditions apply to every offer from the trader and to every distance contract and order concluded between trader and consumer.


Prior to the conclusion of the distance contract, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be stated that the terms and conditions are available for inspection and will be sent free of charge upon request.


If the distance contract is concluded electronically, these terms and conditions may be provided to the consumer electronically in such a way that they can be stored by the consumer on a durable medium.


If, in addition to these general terms and conditions, specific product or service terms apply, the consumer may rely on the provision most favorable to them in case of conflict.


Should any part of these terms be declared void or invalid, the remaining provisions will remain in force. The void provision will be replaced by a valid one that closely reflects the original intention.

Situations not covered in these terms and conditions must be interpreted in the spirit of these conditions. Any ambiguities must be interpreted accordingly as well.

Article 4 – The Offer

If an offer has a limited validity or is conditional, this will be explicitly stated.

The offer is non-binding. Alchemy Apparel London reserves the right to modify or update the offer.

The offer includes a complete and accurate description of the products and/or services offered. Images are truthful representations, although color deviations may occur.

Each offer clearly states the consumer’s rights and obligations upon acceptance, including:

  • The price, excluding customs clearance fees and import VAT;

  • Any applicable shipping costs;

  • How the contract is concluded and what steps are required;

  • Whether the right of withdrawal applies;

  • Payment, delivery, and contract execution details;

  • Acceptance period of the offer;

  • Communication costs if applicable;

  • Archiving of the contract, and accessibility for the consumer;

  • How the consumer can verify and correct input;

  • Available languages for the contract;

  • Applicable codes of conduct and how to access them;

  • Minimum contract duration for long-term agreements;

  • Optional: available sizes, colors, and material types.

Article 5 – The Agreement

The contract is concluded when the consumer accepts the offer and fulfills the conditions set out.

Alchemy Apparel London will confirm receipt of acceptance electronically. Until confirmation is received, the consumer may dissolve the agreement.

The trader shall take appropriate technical and organizational measures for secure data transmission.

Alchemy Apparel London may assess the consumer’s ability to meet payment obligations and refuse an order with justification.

Upon delivery, the following will be provided in writing or on a durable medium:

  • Contact address for complaints;

  • Instructions for exercising the right of withdrawal;

  • Warranty and after-sales service details;

  • The information from Article 4, unless already provided;

  • Termination conditions for long-term agreements.

For duration contracts, the above only applies to the first delivery.

All agreements are subject to product availability.

 

Article 6 – Right of Withdrawal

Consumers may withdraw from the contract within 30 days of receiving the product, without stating a reason.

During this period, consumers should handle the product and packaging carefully.

To exercise the right of withdrawal, the consumer must notify Alchemy Apparel London in writing or via email within 30 days. The product must be returned within another 30 days, with proof of return provided.

If the consumer does not meet these deadlines, the sale is considered final.

 

Article 7 – Costs in Case of Withdrawal

Return shipping costs are fully borne by the consumer, including international shipping to the country of origin (e.g., China).

Any refunds will be issued within 30 days, upon confirmation of return receipt or proof of complete return.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products:

  • Made to the consumer’s specifications;

  • Clearly personal in nature;

  • That cannot be returned due to their nature;

  • That perish or age quickly;

  • Subject to market fluctuations;

  • Newspapers and magazines;

  • Audio/video/software with broken seals;

  • Hygiene products with broken seals.

And for services:

  • Relating to accommodation, transport, restaurant, or leisure with specific dates;

  • That started with the consumer’s explicit consent before the withdrawal period expired;

  • Gambling and lottery services.

Article 9 – The Price

Prices remain unchanged during the validity of the offer, except for VAT changes.

Prices may vary based on financial market fluctuations. This will be clearly stated.

Price increases within three months of agreement formation are only allowed due to legal changes.

No VAT will be charged for goods shipped outside the EU. Import VAT and customs fees will be collected by the postal or courier service in the destination country.

Alchemy Apparel London is not liable for typographical errors and may refuse to honor incorrect prices.

Article 10 – Conformity and Warranty

Alchemy Apparel London guarantees that products meet the contract, specifications, and legal standards.

Additional manufacturer warranties do not affect legal consumer rights.

Defects must be reported within 30 days. Products must be returned in original packaging and condition.

The warranty is void if:

  • Products are altered by the consumer or third parties;

  • Misused or handled contrary to instructions;

  • The issue is caused by government regulations on materials used.

Article 11 – Delivery and Performance

Alchemy Apparel London will take the utmost care in processing and delivering orders.

Delivery address is the one provided by the consumer.

Orders will be fulfilled within 30 days unless otherwise agreed. If delayed, the consumer may cancel and request a refund.

If a product is unavailable, a suitable replacement will be offered. The consumer retains the right of withdrawal for replacement items.

Risk transfers to the consumer upon delivery.

 

Article 12 – Duration Contracts: Termination and Renewal

Termination:

  • Consumers may cancel indefinite contracts with one month’s notice.

  • Fixed-term contracts can be terminated at the end of the term with one month’s notice.

  • Termination must be possible in the same way the contract was entered into.

Renewal:

  • Fixed-term contracts cannot be automatically extended.

  • Exceptions apply to trial newspaper/magazine subscriptions.

Duration:

  • Contracts longer than one year may be cancelled after one year with one month’s notice, unless otherwise agreed.

 

Article 13 – Payment

Unless otherwise agreed, payment must be made within 7 days after the start of the withdrawal period.
